So when will they pass a BUDGET!!!!!

I'm sorry, I don't think that problem about the Debt, Deficit spending, and the Debt Ceiling have been fixed yet!

The people are ignorant and the politicians are expert choreographers and magicians.  Fancy footwork, and the slight of hand will not fix the fiscal disorder we have in Washington. 

Who agrees with me, that the press won't talk about budgets again until sometime in Friday, December 13, 2013, when the "Conference Committee" is to deliver a budget.

There should be pressure on here.  Why aren't the American people up in arms about this.  Our government has not passed a budget in over 5 years.  This is their job, they have failed to do their job for 5 years and we the people just watch TV.

I don't get it. 

In the immortal words of Master Yoda, "do or do not, there is no try". 

Do your jobs congress, you have no choice.  At some point, I have faith, the American people will snap out of the trance they are in.  We will clean house then.

The last three weeks


For several weeks the nation was involved in a debate centered on the topic of the National Debt.  Some in the main stream media have called the end of the partial government shutdown a loss for the Republican Party, a waste time, and harmful to the nation.  If the American people have not decided to become more informed on the failings of congress and the state of the Nation’s fiscal house then I guess I can agree with their summation.  I believe, However, it is never a waste of time to bring to light the ills that need to be healed.  Our government for more than 5 years now has not passed a budget.  We have run fiscal yearly deficit of over $1 Trillion for at least that same number of years and the national debt will soon top $17 Trillion!  The problem with the last few weeks is the talk was not all about Budgets, Debt, Deficits, and Fiscal Responsibility.  Now that again is in my opinion the fault of the Media as well as the Republicans but I hold to the notion that it is never a waste of time to try and bring the debate to the people and discuss the things that need to be fixed.

The Budget, The Deficit, The Debt


So, what we are being told is that the 432 members of the House and the 100 members of the Senate, along with the President; for several years now have been unable to agree on a budget, that too much debt ($17 Trillion + and counting) is not good, and that running Trillion Dollar Deficits every year is not a way to reduce debt.

In the State of Utah where I live, the week following the Government shut down, new unemployment claims surged by 7,000.  I am one of those fortunate souls.  If you take a moment to read back through my posts here you will be able to garner several things:

1.        I am a conservative, constitutionally minded, advocate for change in our
              government.
2.        I think most of the American Electorate, (The People) are simply ignorant
             when it comes to politics, government, and economics.
3.        If the American people do not re-educate themselves, and change their
             government, in the end the US and the world economies will suffer
             greatly.
4.        I do believe that a better America is worth fighting for and that true
             change, by the will of the people, can be accomplished. 

In one day, if 533 Idiots do not raise the Debt Ceiling the U.S. as a nation will experience many harsh realities and people around the world will suffer.  Let us not make any mistake about who is at fault here.  While it is very evident that our elected representatives hold the smoking gun and have their fingers on the trigger, it is our fault that our nation is here at this place now.

We have been here before, the debate about budgets, deficits, and national debt have ebbed and flowed like the tides and we have failed to direct our elected representatives in the matter.  However this again to me is not surprising. I have heard the conversations,

“we can’t cut military spending it will weaken America.”  A good friend of mine

Echo’s the reporting of the day in 2011 as the debate over budgets, deficits, and debt took center stage.  With 2012 Defense spending at $1.4 Trillion Dollars, I think that cuts are very appropriate and necessary.  The task of prioritizing and slimming and cutting out waste should go to the professionals we employ and elect in Washington and the Pentagon and the “this will weaken the US.” BS argument is null because it is their jobs to do what needs to be done with the money provided.

Again echo’s the reporting of the day back in 2011 when the debate over budgets, deficits, and debt was center stage.  Again, we the people have to wake up and gain control of our senses and our government.  If you are on Social Security, Medicare, and Medicaid no worries no change for you.  If your 62 well we just moved the goal post, don’t look for partial benefits till your 65, and none of us should be looking for benefits before 70!  If there is great hardship and inability to care for one’s self we should make exceptions and of course there is major reform needed in the system; the amount individuals pay, corporations pay, and the government pay into the fund as well as in how the fund can be used by the government but this must be part of the plan.

I highlight these two areas because they represent the two grate portions of the Nation’s Budget and the two great sides of the chasm that divides the people and their representatives. 

Start with the big things the rest will follow.  Not changing the way we do things will lead to much greater suffering.

The Right to Rise!

The Right to Rise?  This interesting, “NEW” phrase seen in the Wall Street Journal article, penned by Jeb Bush, on December 19th 2011, is actually a consolidation of several rights that we all should be intuitively aware of.  Look to our country’s founding and the writings of the founders to determine the meaning of this phrase.  If we look at the constitution, we will read,

“We the People in order to form a more perfect Union . . . and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

In this instance the phrase “right to rise” simply refers to the peoples desire to secure the blessings of liberty for themselves and future generations.  We can look back at the Declaration of Independence to garner some evidence about what they meant then, by the “Blessings of Liberty”, though for most they again are intuitive.  The most important of these blessings is the basic concept of the American Government that most profound and basic concept being, all authority, power, rights, and responsibility for governance belong to the individual citizens.  The individual citizens for a period, for a specific reason, voluntarily give permission to their representatives to use said authority, power, rights, and responsibilities to govern for the common good. This is the other piece of the Constitutions Pre-Amble;

“We the People . . . Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty . . . United States of America.”

We the people allow those we place in government to wield our authority for ensuring the opportunity for all to secure the “Blessings of Liberty”.  We declared our Independence because the King and British Parliament took held a monarchical view of governance and inflicted upon the fledgling colonies, laws, regulations, and taxation that inhibited the ability to gain the “Blessings of Liberty”. The complaints of the colonists in the Declaration reaffirm the intuitive nature of the American form of government.  Government exists to serve specific purposes on behalf of, in place of, and at the direction of the people.

So again, the right to rise is the sum total of the American experience, living life in a land governed by a political process created by the People, for the People, at the consent of the People.  A government whose sole purpose, primary objective, and ultimate responsibility is the sustainment and protection of the individual liberties of the people.  The right to life, liberty, and the pursuit of happiness or the attainment of personal property, for the purpose of obtaining an easier, self-styled life for ourselves and future generations.

As we try to define the cause behind the decline of the economy, we would not look to government if we were confident that they are doing the job we asked them to do in the constitution.  When we discover the decline as a direct result of the actions and or in actions of the government, we are shocked.  Some yell at the government “you should have/you should do something” others yell “why did you do that”.  The answer to both sets of screamers is read the constitution, understand it, and compel your elected representative to hold true to its dictates.  Yes, the dictates of the people and the several states found in the constitution, a contract that created the Federal Government and details specifically the things that the Federal Government can and cannot do.  We the people need to know what the constitution says, we must insist that our elected representatives follow the rules established in it, and we must restrain ourselves in our desire to ask for actions that the constitution directly prohibit the Federal Government from doing.

This is the only nation on the face of the earth where each person should wake with an optimistic spirit and a knowledge that if they pursue their desires, work hard, become knowledgeable, and maintain a level of integrity and honesty toward their fellow man then success will come.

Working it out

To all my friends and followers, I recently finished the last class of my last class to complete my Bachelor's in Business with Public Administration. I am so very happy, and I have a ton of time now.  This blog will be one outlet for me along with more time for my kids, and work on the old homestead.  I am not happy with the way the blog looks so expect some changes.  But keep checking it out and pass it on to your friends if you like what you see.  Comment if you have a comment.

tax, spending, and campaign finance amendment.

It Is Time


            It is time to take from the hands of the bureaucrat, professional politician, judicial activist, elitist, private industry, and other government entities, the ability to enslave the population. The manipulation of the public through tax policies, giving from the public treasury for the benefit of supporters, blocking or manipulation to punishment antagonists, these are all examples of the yoke placed upon the people by those who would be King. The government has manipulated the population through taxation and tax policies that provide benefits and subsidies to the Chosen, for much to long and it is time to end this atrocious affront to the personal liberties of the people. It is time to bring this nation back to the standard, of government at the consent of the governed.
I propose the following amendment to the Constitution of the United States.
 
We the people, of the United States of America, understanding that the establishment and maintenance of the federal government requires the expense of the common currency, realizing that historically governments grow and become oppressive, cause the following restrictions upon the federal government of the united States of America. The purpose of this amendment is to put in place an unmistakable barrier to mismanagement and frivolous spending at the hands of the federal government. Further, this amendment is to address the subject of Federal Government Revenue, Federal Government Spending, maintenance of the currency, and the Financing of Campaigns for Election of Elected, Federal Government Officials.
 
Congress shall make no law, regulation, agreement, treaty, or allowance that would change any or all portions of this amendment. The Judiciary may not rule on any challenge that would affect the provisions of this amendment. All current law that stands in contradiction or contrast to this amendment are rescinded.
 
Funds used by the federal government shall come from the following sources and no other.
 
1. A Levy on all imported goods meant for sale to the consumer direct or through a wholesale or retail store of any kind, of 2.5% shall be collected into the treasury. Congress shall make no law, treaty, or arrangement changing restricting or obstructing the collection of said Levy.
 
2. A national sales tax of 2% on all products and services, except for products considered to be individual subsistence, shall be levied against all products and services sold directly to the consumer. Congress shall make no law, treaty, or arrangement, changing or obstructing the collection of said tax.
 
3. A national income tax Levied against the income of all individuals, entities, organizations, corporations and groups as described below.
 
For individual citizens, non-business entities, gross income minus a uniform, standard deduction of $40,000.00 equals taxable income.
 
For business entities, unions, groups, associations, and non-profit organizations, gross income minus a 20% uniform, standard deduction equals taxable income.
If taxable income is equal to $0.00 – $45,000.00 the individual will pay an annual income tax of $250.00.
 
If taxable income is equal to $45,001.00 - $60,000.00 individuals will pay a 2% annual income tax.
If taxable income is equal to $60,001.00 – $80,000.00 Individuals will pay a 4.5% annual income tax.
 
If taxable income is equal to $80,001.00 - $160,000.00 individuals will pay a 7% annual income tax.
 
If taxable income is equal to $160,001.00 - $320,000.00 individuals will pay a 9.5% annual income tax.
 
If taxable income is equal to $320,001.00 - $640,000.00 Individuals will pay a 12% annual income tax.
 
If taxable income is equal to $640,001.00 - $1,280,000.00 individuals will pay 14.5% annual income tax.
If taxable income is equal to $1,280,001.00 - $2,560,000.00 individuals will pay a 15.5% annual income tax.
 
If taxable income is equal to $2,560,001 - $5,120,000.00 individuals will pay a 18% annual income tax.
 
If taxable income is equal to $5,120,001.00 – 9,999,999.99 individuals will pay 20% annual income tax.
 
If taxable income is equal to $10,000,000.00 – or greater, individuals will pay 22% annual income tax.
 
Gross income is the amount of gain to the individual, group, entity, organization, or corporation, in any given calendar year in any form; gifts, property, wages, donations, contributions, dues, revenues, sales, fees, and inheritance, received from any and all entities.
4. Direct use fees for entry into public lands, parks, museums, monuments, and entertainment activities may be collected the fee may not be greater then fees charged in the private market for access to a similar and corresponding type attraction.
 
5. A National Income tax on all gross income earned by all individuals, entities, organizations, corporations and groups of, five tenths of 1 percent, will be collected and placed into a national Social Security trust fund.
 
a. Congress shall not expense funds from this trust for any other reason than to provide support for those citizens who are unable to care for themselves. The term Unable to care for themselves shall be determined by law passed by the congress.
 
b. Congress will constrain the use of the fund in a manner that will allow the fund to continue in perpetuity using the funds collected through the income tax described in paragraph 5. above.
 
c. Congress will not in any way jeopardize the strength, security, standing, and level of balance of the trust through debt, bonding, use as security, and or any other means.
6. The federal government will within 6 months of ratification of this amendment end the employment of all individuals and, end all activities of the Internal Revenue Services and all entities considered subordinate entities of the Internal Revenue Service. Within 10 months of the ratification of this amendment, the federal government will establish the Revenue Accounting and Collections Service (RACS). RACS responsibility is to ensure the unobtrusive collection of revenue to the federal government in accordance with this amendment.
 
7. Congress, RACS, and or any other entity of the federal government may not attach any other increase through fee, fine, penalty or interest to any tax obligation of any entity under the authority of the United States Government.
8. Congress shall make no law, schedule, regulation, or allow any entity to enact regulation, allowing for the transfer of revenue from one source to another source thus negating the obligation of the giving or receiving entity to contribute the stated tax obligation listed in this amendment.
9. The Federal Government of the United States will pass each fiscal year no later then the 29th day of October a budget that is in balance with the following restrictions.
 
            a. Yearly fiscal budgets will be constrained in its spending to a deficit of no more then 5% of the previous years total collected revenue.
 
            b. The national debt may never be greater then 20% of the average collected revenues of the previous 8 fiscal years.
            c. In times of major calamity, after a full and open debate of 360 hours, providing to the general population all information pertaining to the previous year’s budget, current and subsequent years proposed budgets, a super majority of both houses of seven eighths of 100% of the current members, the congress may exceed the deficit and debt restrictions for the current fiscal years budget.
10. Only individual citizens residing in the political district of a candidate may contribute to the candidate’s campaign for a federal government elected position.
 
            a. Individuals must fully disclose all contributions and the contribution may only come from the personal funds owned by the individual.
 
            b. For profit businesses, non-profit organizations, groups, coalitions, unions, and parties headquartered and or doing business in the district of a candidate for the immediate 2 previous years, may contribute a total of $5,000.00 dollars to the candidates campaign for a federal government elected position. All contributions must be immediately and fully disclosed.    
11. Individual that are lawful citizens of the united states may vote and contribute funds to a candidate competing for election to an elected office of the government of the United States of America.
12. Congress shall make no law, treaty, agreement, rule or regulation, which changes any portion of this amendment.

Government Reform through Constitutional Amendment. The Only Way!!!

What we see going on before us is evidence that what Milton Freidman said is fairly accurate.

 
“I do not believe that the solution to our problem is simply to elect the right people. The important thing is to establish a political climate of opinion which will make it politically profitable for the wrong people to do the right thing. Unless it is politically profitable for the wrong people to do the right thing, the right people will not do the right thing either, or if they try, they will shortly be out of office.” (Milton Freidman).

Several months ago, there was a media fire storm about the debt ceiling, some stood there ground and voted for not raising the debt ceiling, others said we always do why wouldn’t we, and those in congress elected to create the “Super Commission”.  Now the super commission is failing to reach an agreement, the automatic reductions in deficit spending are supposed to kick in and cut equally domestic spending and the Defense Department Budget. 

The absolutely insanity that the American People must wake up to is that the proposal for the Super Committee was to find a way to reduce the federal debt of $15 Trillion by only $1.2 trillion over the next 10 years. 

Break it down; that is, reduce spending enough to pay off $1.2 trillion over 10 years.  Or $120 billion each year.  But friends, that is, DEBT, already accumulated debt.  The Federal government at this moment is running a yearly deficit of about $1.56 trillion.

The deficit ads to the debt, so the truth is that to reduce the debt by $120 billion each year for the next 10 years, the government will need to reduce spending by $1.68 trillion or increase revenue by $1.68 trillion more then the total spent $3.83 trillion dollars each year for the next 10 years. 

So how much did we spend in 2011?  $3.83 trillion.

How much did we collect in revenue?  $2.27 Trillion.

For the super committee to reach their stated mandate they must reduce spending or increase revenue while maintaining the spending level of $3.83 trillion.

Reduce spending
$3.83 t  - $1.68 t = $2.15 trillion.  So a budget that must be $2.15 trillion for the next 10 years, while maintaining a total collected revenue of $2.27 trillion.

Or increase revenues over the 2011 total spent + $1.68 trillion. 
$3.83 t + $1.68t= $5.51 trillion.  So a budget that remains $3.83 trillion but revenues of $5.51 trillion. 

What is the most viable option, let us think this out.  When was the last time US total collected revenue was $ 2.27 trillion?  2011. When was the last time US total collected revenue was $5.51 trillion? Never.

So to cut $1.68 trillion dollars from the 2011 budget.  What could we cut?

Wait stop, now that we are here lets talk about the fact that if we accomplished one or the other for the next 10 years, then the Federal Debt in 2021 will still be $13.8 Trillion!

It is painfully obvious to anyone with eyes, and a functioning brain that something must be done.  This is a start but it is not enough and it is clear that we can not count upon the wrong or the right people to do what is right and necessary.

So I propose, that it is time to reform government through constitutional amendment.  But wait, how is it that we gain a constitutional amendment? 

The Constitution, may be ammended through several prcesses;

Amendments proposed by the states in convention or by the states legislatures and then ratified by the states in convention or the states legislatures. 
Ammendments proposed by the Congress and then ratified by the states either in convention or by the states legislatures.

But if we can not count on the federal legislature to do the right thing how do we the people get and Amendment going? 

We must have enough of the population in enough of the states agreeing and motivating the states legislatures to look at a proposed amendment agree to it and ratify it.

This is what must happen.

What do you think about this proposal

the money taken from your check and the money that your employer gives in Social Security Tax buys a U.S. Savings Bond the face value is double the total taken.  (i.e.  you donate $100.00 your emplyer gives $100.00, total $200.00, you get a bond worth $400.00).  These bonds would be special in that you could not use them until you reach the age of 65 and or if meeting certain requirements you can use them if you become disabled.  The funds would as the with current savings bonds go into the general fund and the government has the ability to plan for the payment out of the bonds and never threaten to not be able to send out the checks.  You have a tangeble investment in you hand and can count the amount you have a plan accordingly, choosing to give the standard amount or invest more, with Social Security or invest more somewhere else?

It is Time, To take from the hands of the bueracrat, politician, judicial activist, eleitist, government entity the ability to enslave the population.

Enslavement by either providing benefit or manipulation of the tax code.  This is not an appropriate activity for the federal government, the government has participated in the activity of manipulation of the population through taxation an the providing of benefits/subsidies for much to long and it is time to end this attrocious affront to the personall liberties of the people.  It is time to once again bring this nation back to the standard of, government at the consent  of the governed.

How will this be accomplished? Constitutioanl Ammendment XXVIII;

We the people understanding that the establishment and maintenance of the federal government requires the expense of the common currency.  Realizing that historically governemtents grow and become oppressive, we cause the following restrictions upon the federal government of the united States of America.

All portions of the constitution, ammendments, and articles that stand in contradiction to this ammendment are recinded.  All current law that stands in contradiction or contrast to this ammendment are recinded. 

The purpose of this ammendment is to address the subject of Federal Government Revenue, Federal Government Spending, and the Financing of Campaigns forElection of Federal Government Representatives.

Funds used by the federal government shall come from the following sources and no other.

1.  A levi on all imported goods meant for sale to the consumer of 2.5% shall be levied against all said goods.  Congress shall make no law changing or obstructing the collection of said levi.

2.  A national sales tax of 2% on all products and services to the consumer except for products considered to be individual subsistance shall be levied against all producst and services sold directly to the consumer.  Congress shall make no law changing or obstructing the collection of said tax.

3.  A national income tax shall be levied against the income of all individuals, entities, organizations, corporations and groups of 5%, allowing for the adjustment of gross income for the following allowable expenses. Income is the amount of gain to the individual, group, entity, organization, or corporation in any given calendar year in the form of wages, revenuse from sales, fees, dues, gifts, and inheritance, received from employers, customers, acquaintences, family, frinds, agencies, organizations, and or members.

            a.  Income shall be impacted negatively by the documentable cost to the entity for employing individuals to include wages and health benefits, dental benefits, preventive health penefits, mental health benefits, unemployment insurance, and disability insurance. 

            b.  Income shall be impacted negatively by the documentable cost of contributions of funds to a recognized investment intended for use in retirement, disabillity, or later years of life in the amount of 3.5 % of the individual’s and entity’s total gross income.

            c.  Income shall be impacted negatively by the documentable cost of physical, infrastracture and equipment maintenance and purchase for business entities.   

4.  Direct use fees for entry into public lands, parks, museums, monuments, and entertainment activities may be collected the fee may not be greater then fees charged in the private market for access to a simalair and corresponding type attraction.

A way out of the economic slump.

Support and push and American Energy Policy that embraces and calls for an increase in all forms of energy acquisition, production, and distribution.  

Wind, Solar, Coal, Geo-Thermal, Hydro Electric, Nuclear, Natural Gas and Petroleum, there is a projected need for energy that supports a large scale increase in generating capacity of all types of energy. 

The goal should be to increase output in all areas to the point that the cost for electricity for the consumer declines. 

With this planned increase would come a need to renovate and expand the nations electrical grid.  This plan also provides for the addition of private and public sector jobs, short and long term employment, in low tech, medium tech, and high tech fields.

Additionally, support and push a policy of increase fossil fuel acquisition, specifically coal and oil from US reserve along with an increase in refining capacity.  Again there is a projected need for more gasoline that support a large scale increase in generation of and greater acquisition of as well as refining of oil. 

The goal again should be to increase the production to the point that the cost of gasoline to the consumer would decrease. 

With the decrease in cost, a modest increase in tax on gas at the pump, for the specific purpose of expanding the nations energy network of non-fossil fuels (green energy) and cleaner burning natural gas is in order.

The policies would additionally strengthen the position of American sovereignty, fiscal stability, and standing in world affairs.

A way to fix all our problems in the United States

This Idea will also eventually, translate to good things for the world.  This is in response to the Omnibus bill with 8 Billion $s of earmarks that just got shot down, and the extension of the current tax rates that recently past and will be signed into law today.

Here is the idea.

The Clarity in Legislation Amendment

Original Intent;  The purpose and intent of the people in the following amendment to the constitution of the united States of America is to ensure that legislation and law is clear, concise, understandable, and in concert with the ultimate purpose of constitution, and role of the Federal Government; To secure, protect, and defend the constitution of the united States of America and the individual liberties, rights and authorities of the people while providing for the common defense and the general welfare of the nation.

Declaration;  We the people of the united States of America understanding the necessity for law, as well as the tendency for governments to trend toward oppression and tyranny, demand the following restrictions upon the congress as they fulfill the role and purpose of drafting law and providing for the enacting and enforcement of the law.

Restrictions and protections:

     The congress in drafting legislation shall ensure that the proposed bill submitted to the congress is a document authored by an active sitting member of congress.  Active sitting members of congress may solicit information form outside entities to use in the development and writing of proposed bills to the congress but may not use complete and drafted documents in whole or part, that were written by non active sitting members of congress.
    The Chief-executive of the nation may submit recommended legislation in whole or part to the congress for consideration.  The Chief-executive may solicit information form outside entities to use in the development and writing of proposed bills to the congress but may not use complete and drafted documents in whole or part, that were written by non active sitting members of congress, or sitting active employees of the executive branch.
     Proposed bills and final approved bills will not exceed 100 written pages.  The pages will be 8”x 11 ½” white bond paper with 1 inch margins top, bottom, left and right, double spaced typed, times new roman Font, each line numbered within the left hand margin. 
     The title of proposed and final approved bills will include language that clearly communicates the intended purpose of the bill, the title will be no longer then 20 words.
     The proposed bill and final approved bill will have a constitutional adherence statement clearly communicating how the author and the congress believe the bill is within the constraints and addresses an authority granted congress and the federal government through the constitution of the united States of America.
      The proposed bill will be read aloud in its entirety with all amendments before the congress before a vote, is taken.  The proposed bill and amendments will be distributed in common fashion to the people for consideration before congress votes upon the bill consideration will consist of 168 hours.  Amendments to a proposed bill must be in congruence with the title, and content of the bill.
     This Amendment will be retroactively applied to all legislation passed by the congress dating back to and including law passed during the 101st congress of the united States of America.
